The petitioner had filed the present petition under Section 482 BNSS with a prayer to grant of anticipatory bail to her in case FIR No.67 dated 22.03.2025, under Sections 121(1), 132, 221 of BNS, 2023 registered at Police Station Guhla, District Kaithal. 2. The FIR in the present case was registered on the basis of the statement made by Head Constable, Vijender Kumar and the same has been reproduced below:- “Statement HC Vijender Kumar NO. 167 Kaithal Police Chowki Ramthali Mobile No.9068763882 states that I am posted as Investigating Officer at Police Chowki Ramthali. Today on dated 22.03.2025 I was received one complaint bearing No. VIPIN KUMAR 2025.05.23 16:45 I attest to the accuracy and integrity of this judgment/order CRM-M-26104-2025 -2- 13228016250122 for inquiry that regarding investigation the above said Complainant Pintu son of Mange Ram, resident of Kasoor that notice has been served for attend the inquiry that I and HGH Amit Kumar No.02/ Kaithal on a Government Vehicle bearing registration No.HR08-GV-4462 which was driven by driver HKRN Gurtej Singh was reached at the house of Pintu at village Kasoor for inquiry. That there was so many ladies and gents were present after finding out from whom and was asked to take a notice for coming at the police Chowki Ramthali today in evening. Pintu immediately started giving abuses to me and also gave slapped on my face. That in the meantime, other peoples, gents and ladies present there also started giving beating to me. All these took me to the street while beating and also in the street they have started beating to me and screamed over and over again bring the gandasi. I told to all the employees to inform the Police Chowki, and on getting to know about the arrival of police from the Police chowki all the ladies and gents who gave beating to me ran away from the spot. I inquired about on my own that the name of the accused as Bintu son of Mangi Ram, Jitender @ Golu son of Maggi Ram, Bintu's wife Suman, Sheenu son of Maggi Ram, Ajay son of Om, resident of Kasoor. That all the persons in connivance with each other gave beat up even when I was on duty. They have torn the Khakhi Shirt of my official Uniform and also they obstructed government duty. The videography has been done the place of occurrence by my fellow officers, which I will present to you later. It is requested to you that strict legal action has been taken against all the accused persons. Statement given heard correct. Learned counsel for the petitioner contends that the petitioner is a rustic and poor lady and has been falsely involved by the police in the present VIPIN KUMAR 2025.05.23 16:45 I attest to the accuracy and integrity of this judgment/order CRM-M-26104-2025 -3- case. Even Bintu, her husband has already been arrested by the police and is in custody. Further, the injuries suffered by the complainant in the present case are simple in nature and there is no other material to connect the petitioner with the commission of the alleged crime. 4. On the other hand, learned State counsel has filed a status report by way of an affidavit of Deputy Superintendent of Police, Guhla on behalf of the respondent-State and the same is taken on record. He submits that the entire occurrence in the present case was recorded in a camra and as per the CCTV footage, which has been presented in a pen drive Annexure R-2, the petitioner is clearly visible and she alongwith other villagers had caused injuries to the Head Constable, Vijender Kumar, who is performing his official duty. He further submits that the police official was seriously beaten up and he had suffered the following injuries:- “Simple, Grievous, Dangerous or pending for observation.” 5. Learned State counsel further submits that even the official uniform of the injured was torned by the petitioner and her accomplices. Thus, the present petition deserves to be dismissed by this Court. 6. I have heard the learned counsel for the parties and perused the record. 7. In the present case, there are serious allegations against the petitioner and other co-villagers, who had beaten up a police official, who was discharging his official duties. Not only his uniform was torned, but was also caused serious injuries on his person, which is apparent from the MLR prepared by the doctors Annexure R-1. In fact the allegations levelled against the present VIPIN KUMAR 2025.05.23 16:45 I attest to the accuracy and integrity of this judgment/order CRM-M-26104-2025 -4- petitioner are serious in nature and keeping in view of the grevity of the offence, the petitioner does not deserves the concession of anticipatory bail.
