T VENU GOPAL 4. .... 7 The Court made the following common order: As the issue involved in these two contempt cases is one and the same, they are being disposed of, by way of this common order. 2. This Court by an order, dated 15.03.2021 in W.P.No.13107 of 2020 had directed the respondents herein to ascertain the amounts payable to the petitioners, on account of non-payment of salaries to the petitioners within a period of one (1) month from the date of the order. 3. As, such attempts had not been made, the petitioners approached this Court by way of these two contempt cases. 4. In the course of the proceedings, the respondents have taken the plea that the respondent’s college has been closed on account of lack of funds and that no funds are available with the college for making any payment. 5. However, the respondents made payment of Rs.27,77,824/- to the petitioner in W.P.No.13048 of 2020 and a sum of Rs.14,13,093/- to the petitioner in W.P.No.13107 of 2020. 6. Thereafter, the case underwent number of adjournments. This Court, with a view to ensure compliance of the direction of this Court, had requested the respondents to set out the funds available with the respondents as well as other means of payment of amounts due to the petitioners on account of the directions of this Court. 8 7. The 9th respondent having filed additional counter-affidavit on 09.09.2025, stating that total amount of Rs.90,98,669/- is available in the bank accounts maintained by the College / Society and that there are claims of 12 employees of the College, to an extent of Rs.2,57,22,569/-. 8. In view of the fact that the petitioners have been partially compensated for non-payment of the salary and in view of the fact that other similarly situated employees are still waiting for some payments, it would not be equitable for this Court to insist that the entire amount left with the respondents should be disbursed to the petitioners. 9. In such circumstances, both the Contempt Cases are closed leaving it open to the petitioners to avail such remedies available for recovery of arrears due to the petitioners. It is however, made clear that in the event of the respondents raising any further funds, it would be open to the petitioners to approach this Court by way of a fresh contempt case. There shall be no order as to costs. As a sequel, pending miscellaneous applications, if any, shall stand closed. ________________________ R.
