1. Mr. Gaurav Singh, learned counsel for the applicant.
2. Mr. Siddharath Bisht, learned Assistant Government Advocate and Mr. Himanshu Sain, learned Brief Holder for the State.

Present applicant ‘Alishan, son of Iliyas’ is praying for regular bail in relation to First Information Report dated 24.03.2025 bearing FIR No. 345 of 2025, Police Station – Laksar, District – Haridwar, wherein present applicant has been implicated for the offences punishable under Sections 8 / 22 of the NDPS Act.

Learned counsel for the applicant submits that alleged prohibited drugs namely 25 injections of Tramadol Hydrochloride (50 mg / 2 ml), 160 tablets of Alprazolam, 110 tablets of Chlorodiazepoxide and Trifluoperazine tablets 10 mg were shown to be recovered from the present applicant, which are below commercial quantity and in fact, present applicant, is a license holder under the Drugs and Cosmetics Act, 1940 and his license is valid uptil 22.09.2029. He submits that the entire case was planted by the Investigating Officer, which is evident from the fact that applicant was shown to be arrested from different place though as per CCTV applicant was arrested from his shop. He further submits that applicant has no previous criminal history.
5. On the other side, learned State Counsel submits that investigation is still going on but he has denied this fact that applicant was shown to be arrested from different place
2025:UHC:3905 however, he has not disputed this fact that applicant is a license holder under the Drug and Cosmetic Act and his license is valid till 22.09.2029 and has no previous criminal history.
6. After hearing the arguments of learned counsel for the parties and further taking into
consideration that applicant is a license holder under the Drug and Cosmetic Act and his license is valid till 22.09.2029 and present applicant has no criminal history, this Court is of the view that applicant deserves for bail.
7. Accordingly, without expressing any opinion on the merit of the case, the bail application is allowed.
8. Let the applicant ‘Alishan’ be released on bail on furnishing his personal bond and two sureties each of the like amount to the satisfaction of the court concerned.
9. It is made clear that after releasing on bail, applicant shall cooperate with pending investigation.
