BEFORE HONOURABLE MR. JUSTICE ROBIN PHUKAN ORDER Date : 10.02.2025
Heard Mr. N. Ahmed, learned counsel for the applicants. Also heard Mr. A.J. Saikia, learned counsel for the respondent. 2. This interlocutory application is preferred by the applicants for correction of the number of the MAC Appeal No. 54/2018, as reflected in the order dated 23.10.2024, in I.A.(Civil) No. 2854/2024, in MAC Appeal No. 46/2024. 3. Mr. Ahmed, learned counsel for the applicants submits that in an interlocutory application filed by the applicants for releasing a sum of Rs. 6,62,200/-, this Court was pleased to allow the applicants to withdraw the aforementioned amount deposited by the respondent, before the Registry of this Court. In the said order, the number of MAC Appeal was mentioned as 54/2018, but, the number ought to have been MAC Appeal No. 46/2024, and because of this discrepancy, the applicants have not been able to withdraw the amount from the Registry of this Court and as such, it is contended to make necessary correction in the order dated 23.10.2024, in I.A.(Civil) No. 2854/2024, in MAC Appeal No. 46/2024. 4. Having heard the submissions of learned Advocates of both sides, I have carefully gone through the application and the documents placed on record and also perused the order dated 23.10.2024. 5.
It appears that the number of the MAC Appeal was wrongly mentioned in
Page No.# 3/3 the interlocutory application itself by the applicants, for which in the order dated 23.10.2024, it was mentioned as MAC Appeal No. 54/2018. But, in fact, the same ought to have been MAC Appeal No. 46/2024. 6. In view of the above, it is provided that henceforth, MAC Appeal No. 54/2018 appearing in the order dated 23.10.2024, shall be read as MAC Appeal No. 46/2024. 7. In terms of above, this interlocutory application stands disposed of. JUDGE Comparing Assistant
