Mr. Shounak Mallick, Adv. …for the defendant The Court: The instant suit is for infringement and passing off. The basic grievance of the plaintiffs is directed against the impugned trade mark “ABLUE VALLEY” and the corresponding impugned trade tress being used by the defendant. The matter has been heard on several occasions. In view of the prior directions of Court, the defendant has affirmed an affidavit on 1 September, 2025, unconditionally agreeing to change the impugned mark alongwith trade dress and carry out their business operations under the proposed name “AGASTYA”. The affidavit affirmed by the defendant be kept with the records. 2 In response, it is submitted on behalf of the plaintiffs that they have no remaining grievance and the disputes between the parties stand resolved. In view of the unconditional undertaking given by the defendant that they are changing their existing name to “AGASTYA” nothing remains to be adjudicated upon in this suit.
