The learned Counsel for the petitioner and respondent are present and the respective parties are also present. 2. Both the counsel submit that the joint memo is signed by respondent and the petitioner. The joint memo reads as follows:
1. The petitioner has preferred this petition challenging the Judgment passed by the Prl. Sr. Civil Judge & JMFC at Hunsur in CC.No.735/2018 dated 24.02.2021. 2. Both parties have agreed to settle the dispute amicably in terms of this Joint memo and for a sum of Rs.3,46,500/- as full and final settlement. 3. The petitioner/accused had deposited a sum of Rs.3,46,500/- before the Trial court and permitted the Respondent/complainant to withdraw the same. 3A. The parties are prayed to Acquit the petitioner by setting aside the Judgments of Trial Court and 1st Appellant Court. 4. Both parties have agreed to dispose the above petition as per the terms of this Joint Memo. 3. As per the joint memo, the parties have settled the matter for a sum of Rs.3,46,500/- (Rupees Three Lakhs Forty Six Thousand
3 and Five Hundred Only) in full settlement of the cheque amount. Since the parties have mutually agreed to compound the offence, the case against the petitioner/accused stands compounded. The petitioner is acquitted of offence under Section 138 of the Negotiable Instruments Act, 1881.
4. The said submission is taken on record. 5. The sum of Rs.3,46,500/- (Rupees Three Lakhs Forty-Six Thousand and Five Hundred Only) deposited before the Trial Court shall be digitally released to the respondent/complainant upon furnishing the required documents. A copy of the respondent's Aadhaar card has been submitted as proof of identity. Sd/- JUDGE
