“10.1 That, this Hon'ble Court may issue a suitable writ directing the respondents to permit the petitioner to resume his duties. 10.2 That, That, this Hon'ble Court may direct the respondents to extend the service of the petitioner and pay him salary for three years. 10.3 That, this Hon'ble Court may kindly be pleased to grant any other relief or pass such other and further orders as may be deemed fit and proper in the facts and circumstances of the present case in the interest of justice.”

Brief facts of the case, is that, the petitioner had been engaged in the service of the respondent from 01.05.2018 to 10.08.2022 and was working under the Baiga Development Authority on the post of Data Entry Operator at Collector rate, during which period she satisfactorily discharged her duties and received all service- related benefits from time to time. An Experience Certificate dated 06.03.2021 was also issued in her favour by the Chief Executive Officer, Janpad Panchayat, Bharatpur, Chhattisgarh, acknowledging her service. The petitioner thereafter applied through the PM portal seeking extension of her contractual engagement and release of salary for three years, pursuant to which a communication was received in the Collector’s office and forwarded to the Chief Executive Officer, Janpad Panchayat, Bharatpur, Chhattisgarh on 08.12.2022 for necessary action. 3 Subsequently, the petitioner also submitted a letter dated 13.01.2023 to the respondent reiterating her request for extension of contractual service and payment of salary for the said period. 3.
Learned counsel for the petitioner submits that respondent No. 3 has taken work from the petitioner for about 3 years, however, she has been given remuneration for only one year and rest of the part she has not been given any remuneration. 4. Learned counsel for respondent No. 3 submits that the allotment is only for one year and the work of the petitioner has been taken for only one year and the entire remuneration for that period has already been given to the petitioner. There is no amount is left with respondent No. 3 as such nothing can be paid to the petitioner. He has placed reilance upon the memo dated 20.12.2022 issued by CEO, Janpad Panchayat Bharatpur, District-MCB, C.G.
5. The petitioner dispute the same stating that the petitioner has worked. He has filed a document which is an order dated 5.7.2022 in which he is submitting that the Project Administrator, ITDB has issued a letter to the CEO, Janpad Panchayat, District-Koriya, C.G. stating that कि पूजा किቦኋ (बैगा ्ቚ्) डाटा एन्टा ऑपूरेटारे पूद पूरे आपू ኋलኋ लक्टारे दरे ኋरेत है। गात तन वኘ᭩&' से इन नदኋ नहै* किदኋ गाኋ है। पूजा किቦኋ किसे आदश तहैत लक्टारे दरे पूरे रेखा गाኋ है।
4 तथा किसे आधारे पूरे नदኋ किदኋ जा रेहै है। goes to show that that the petitioner has worked for the said period. 6. Learned counsel for the State also supports the contention raised by respondent No. 3 stating that the petitioner has not worked for about three years. 7. I have heard learned counsel for the parties and perused the material available on record. 8. From the perusal of Annexure-R-3/1 annexed with the writ petition, it appears that the scheme for the year 2017-18 and the allotment of Rs.
8,35,900/- has been allotted for the said period under the Special Tribe in which the petitioner has worked and the work and the funds were allotted only for one year. 9. Considering the disputed questions of the facts involved in this writ petition the petitioner is granted at liberty to approach before the concerned authorities within a period of two weeks and, in turn, the concerned authorities are directed to redressed the grievance as raised by the petitioner within a period of four weeks from the date of receipt of copy of this order.
