Even otherwise, it can be seen from the record that the notice, dated 10.5.2024, which is stated to be a notice invoking the arbitration clause, has been addressed not to the Company, which is a legal entity, but to an Officer of the Company by name Sri K. Santhosha Rao. This certainly does not 2 HCJ Arb_appl_26_2024 satisfy the requirement of serving upon the Company a notice for invoking the arbitration clause. 3. In that view of the matter, learned counsel for the petitioner seeks to withdraw the present petition with liberty to file the Arbitration Application afresh after duly serving upon the Company a notice invoking the arbitration clause under the Arbitration and Conciliation Act, 1996, as also incorporating the necessary parties. The Arbitration Application is, accordingly, dismissed as withdrawn with liberty as prayed for. No costs. Pending miscellaneous applications, if any, shall stand closed.
