GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the in inaction of the respondents Nos. 2 to 3 in considering the petitioner's representation by way of legal notice dt. 16-07-2021 for to take steps to record statements in crime No. 248 of 2020 U/sec 341, 447, and 506 of 1PC., before the learned JFCM, Kothapeta, East Godavari district of his witness including himself in pursuance of the 3rd respondent issued memo dt.29.11.2020, as illegal, arbitrary and against settled principles of law and consequently direct the respondents No. 2 and 3 considering the petitioner's representation by way of legal notice dt. 16- 07-2021 for to take steps to record statements in crime no 248 of 2020 2 U/sec 341, 447, and 506 of IPC., before the learned JFCM, Kothapeta, East Godavari district.” 2. Ms.Kalla Tulasi Durgamba, learned counsel for the Petitioner would submit that let there by a direction to record the statements of the witnesses before the Court of Judicial First Class Magistrate, Kothapeta in Crime No.248 of 2020. 3. Sri V.Farooq, learned Assistant Government Pleader for Home, would submit that the Court may pass appropriate orders. 4. Considering the submissions made, the Writ Petition is disposed of directing the Respondents - Police to conclude the investigation in Crime No.248 of 2020 on the file of Kothapeta Police Station, if not concluded, and file a report in accordance with law, within a period of two months from the date of receipt of copy of this order. There shall be no order as to costs.
