1. This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:-
“1. Allow the present Petition of the Petitioners;
2. Issue a writ of mandamus or any other appropriate writ,
order or direction for quashing the unlawful and illegal declaration/classification of the Loan Account (IndusInd Bank Account No.700000003501) of the Petitioners as NPA on February 28, 2020;
3. Issue a writ of mandamus or any other appropriate writ,

adequate proceedings against the Respondent banks/financial institutions for such unlawful and illegal declaration/classification of the Loan Account (IndusInd Bank Account No.700000003501) of the Petitioners as NPA on February 28, 2020;....”
2. Mr. Agarwal, learned counsel for the petitioners states that the loan account of the petitioners has been wrongly classified as a Non-performing asset (NPA) on 28.02.2020 as the said action is contrary to the RBI Master Circular dated 01.07.2014.
3. The petitioners have already approached the Debts Recovery Tribunal seeking the same prayers/reliefs by filing Securitisation Application bearing No. 329/2025, which is pending before the tribunal but the interim relief of stay has not been granted to the petitioners.
4. I am of the view that the petitioner has an equally efficacious alternate remedy of challenging the order of Debts Recovery Tribunal dated 06.10.2025 before the Debts Recovery Appellate Tribunal (“DRAT”).
5. In case the petitioners are aggrieved by any action/inaction on part of the DRAT, the petitioners shall be entitled to challenge the same in accordance with law.
6. With these directions, the petition is disposed of.
