JUSTICE R.K. PATTANAIK Order No. ORDER 24.09.2025 01. 1. Heard learned counsel for the petitioner and Mr. Sahoo, learned ASC for the State. 2. Instant petition is filed for release of the petitioner on bail in connection with Sub-Inspector of Excise, Striking Force, Chhatrapur P.R. No. 162 of 2025 corresponding to 2(a) C.C. Case No.280 of 2025 pending in the file of learned JMFC Khallikote on the grounds stated therein. 3. Perused the P.R. at Annexure-1 and rejection order i.e.Annexure-2. 4. The Court finds that 180 liters of I.D. liquor was being transported by the petitioner in a Scooty at the time when he was intercepted by the Excise Police. Page 2 of 3 5. It is claimed that the petitioner is having no other criminal antecedent and is in custody from 31st August, 2025 and being a local, he should be allowed to go on bail. 6. An objection is received from Mr. Sahoo, learned ASC for the State against release of the petitioner. 7. It is informed to the Court that the investigation is still in progress. 8. Having regard to the fact that the recovery and seizure is already accomplished and under the impression that substantial part of investigation is to be over and in view of the plea that the petitioner is having no other antecedent, the Court, recording the objection of Mr. Sahoo, learned ASC for the State, is in favour of releasing him on bail with conditions. 9. Accordingly, it is ordered. 10. In the result, the petition stands allowed. As a necessary corollary, the petitioner is directed to be released on bail in connection with Sub-Inspector of Excise, Striking Force, Chhatrapur P.R. No. 162 of 2025 corresponding to 2(a) C.C. Case No.280 of 2025 subject to him furnishing a bail bond of Rs.50,000/- (rupees fifty thousand) with one solvent surety for the like amount to the satisfaction of the learned JMFC, Khallikote who shall impose such other conditions as deemed just and proper in the facts and circumstances of the case besides the following, such as, he shall attend the P.S. once in a fortnight and report the I.O. for the purpose of investigation and continue to do so till the same is over and such release shall be upon verification and absence of similar criminal antecedent pending against him. 11.
