2. The petitioner has filed this petition with following prayers:
“1. That, the Hon’ble Court may kindly be pleased to allow the instant petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, filed by the petitioner.
2. It is therefore prayed before this Hon’ble Court may kindly be pleased to allow the present Application and restore the CRMP No.1857/2025, in the matter of ‘Virendra Kumar Ware Vs. State of Chhattisgarh & Another’ in the interest of justice.”

Learned counsel for the petitioner seeks permission of this Court to withdraw this petition with liberty to challenge the order framing charge as charge has already been framed against the petitioner.
