Respondent For Applicant : Shri Rajeev Shrivastava, Sr. Advocate along with Shri Himanshu Pandey, Advocate. For Respondent/State : Shri Jitendra Shrivastava, G.A. and Shri Soumya Rai, PL. Hon'ble Mr. Ramesh Sinha, Chief Justice Order on Board 10/11/2025 1. This is the fourth bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.117/2024 registered at Police Station G.R.P, District Bilaspur (C.G) for the offence punishable under Section 20B, 29 of NDPS Act. 2. Case of the prosecution, in brief, is that on the basis of information from GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.11.11 18:40:31 +0530 2 an informer, on 23.10.2024, the Police of Police Station G.R.P. Bilaspur, conducted a raid and seized total 20 kgs contraband Ganja valued at Rs. 40,000/- from two persons, 10 kg of illegal ganja from the possession of accused Yogesh Sondhiya and 10 kg of illegal ganja from the possession of accused Rohit Dwivedi at platform No.2 & 3 of Railway Station Bilaspur. Further investigation of the case was done by Anti-Crime Cyber Unit (hereinafter referred as A.C.C.U.) Bilaspur and on the basis of the memorandum statement given by them on 24.10.2024, 4 constables posted in Police Station G.R.P. Laxman Gain, Mannu Prajapati (applicant), Santosh Rathore and Saurabh Nagvanshi were also made accused and arrested, and thereafter, during the course of investigation by A.C.C.U., another accused Shyamdhar Chaudhary was also arrested. 3. Learned counsel for the applicant submitted that this is the fourth bail application of the applicant and the first bail application was rejected by this court on 13/02/2025 in MCRC No.1150/2025 and thereafter he moved a second bail application which was rejected on 11/04/2025 vide MCRC No.2909/2025 and the third bail application was rejected on 15/07/2025 in MCRC No.4851/2025 against which the applicant preferred a SLP before the Apex Court which too has been dismissed on 18/08/2025. It is stated that the applicant’s son is suffering from Wilson’s disease and his liver transplant is to be done for which he prays for grant of temporary bail. 4. On the other hand, learned State counsel opposes the prayer for grant of bail. 5. I have heard learned counsel for the parties and perused the materials 3 available on record. 6. From perusal of the records, it transpires that this is the fourth bail application of the applicant, first bail application was rejected by this court on 13/02/2025 in MCRC No.1150/2025, second bail application was rejected on 11/04/2025 vide MCRC No.2909/2025 and third bail application was rejected on 15/07/2025 in MCRC No.4851/2025 against which the applicant preferred a SLP before the Apex Court which too has been dismissed on 18/08/2025. Considering the fact that the earlier three bail applications have been rejected by this Court on merits and against the last order rejecting bail on 15/07/2025 third bail application, SLP was preferred before the Apex Court, same has been dismissed, therefore I am not inclined to entertain this fourth bail application. 7. Accordingly, the fourth bail application of the applicant- Mannu Prajapati, involved in Crime No.117/2024 registered at Police Station G.R.P, District Bilaspur (C.G) for the offence punishable under Section 20B, 29 of NDPS Act, is rejected. 8. In view of the above, I.A. No.01/2025 application for grant of interim bail stands disposed of. 9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information. Sd/- Sd/- (Ramesh Sinha) CHIEF JUSTICE gouri
