IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 1871 of 2025 ------- Suraj Mahli, aged about 18 years, son of Sulendra Mahli, resident of village Ward No.7, Village Buti, P.O. Buti, P.S. Senha, District Lohardaga. …... …. Petitioner(s) Versus The State of Jharkhand .…. …. Opp. Party -------- CORAM : HON’BLE MR. JUSTICE AMBUJ NATH -------- For the Petitioner(s) : Mr. Arvind Prajapati, Advocate For the State : Mr. Nawin Kr. Singh, A.P.P. -------- 04/ Dated 10.03.2025 Heard the parties. The petitioner has been made accused in connection with Senha P.S. Case No. 80 of 2024, Spl. POCSO Case No.41 of 2024, for the offence registered under Sections 137(2) & 96 of the B.N.S., 2023, pending in the court of learned Additional Sessions Judge-I-cum-Special Judge, POCSO, Lohardaga. Petitioner is alleged to have enticed 14 years old daughter of the informant with an intention to marry her. From the impugned order, it appears that victim after being infatuated with the petitioner left her lawful guardianship. It also appears that petitioner went to his relative’s house with her, where they established physical relationship. The age of the victim is 14 years. The consent of victim for physical relationship has got no legal sanctity in this case. In view of the aforesaid fact, I am not inclined to release the petitioner, on bail. Accordingly, the prayer for bail of the petitioner is hereby rejected at this stage. (Ambuj Nath, J.) BS/-
