JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, the petitioner seeks for quashing the entire proceedings in S.C.No.1054/2024 on the file of the XIII Additional City Civil and Sessions Judge at Bangalore (CCH-22) registered for the offences punishable under Sections 120B, 201, 302, 34 of IPC in Crime No.137/2024 of Halasur Police Station, insofar as petitioner is concerned. - 3 - HC-KAR NC: 2025:KHC:44218 CRL.P No. 12018 of 2025 2. After arguing the matter for some time, learned counsel for the petitioner submits that the impugned proceedings in S.C.No.1054/2024 is posted today i.e., 04.11.2025 for framing of charges and the present petition may be disposed of as withdraw, reserving liberty in favour of the petitioner to seek discharge before the trial Court, which may be directed to consider the request of the petitioner/application for discharge by permitting him to file discharge application and consider the same and thereafter proceed further in accordance with law. 3. Submission is placed on record. 4. The petition stands disposed of as withdrawn, reserving liberty in favour of the petitioner to request the trial Court for discharge and also file an application for discharge before the trial Court. 5. The trial Court, before whom the proceedings in S.C.No.1054/2024 are posted today i.e., 04.11.2025 is directed to defer the matter by a period of 2 weeks, so as - 4 - HC-KAR NC: 2025:KHC:44218 CRL.P No. 12018 of 2025 to enable the petitioner to make an application for discharge. Upon such application being filed by the petitioner on the next date of hearing of S.C.No.1054/2024 before the trial Court, the trial Court shall consider the said application and pass appropriate orders and thereafter proceed further in accordance with law.
