The applicant has preferred this application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of Bail, apprehending his arrest in connection with Crime No. 39/2025, registered at Police Station – Kusmi, District – Balrampur - Ramanujganj (C.G.) for the alleged commission of offence punishable under Sections 420, 409, 467, 468, 471, 120 (B), 34 of the Indian Penal Code, 1860.

As per the prosecution story in brief, is that an FIR was registered on the basis of a letter issued by the Branch Manager of the District Cooperative Bank, Ambikapur, according to the complaint, the applicant was working as cashier (substantive post – Samiti Prabandhak, Adim Jati Seva Sahkari Samiti Bank) while Ashok Kumar Soni was working as Assistant Chief
2 Supervisor and Attaval Singh, Vijay Kumar Uikey and Shamal Sai were working as Branch managers along with other accused persons, misappropriated some amounts in 10 to 15 different bank accounts. When the above fact came to the knowledge of the Chief Executive Officer, Shankargarh, a committee was constituted for enquiry and according to the report, there was misappropriation in 138 entries, the misappropriation took place during the period from 2013-14 to 2023-24 and the total amount misappropriated has been calculated to be Rs. 26,47,82,462/-. Hence, this application.

Learned counsel for the applicant submits that the first bail application was rejected by this Court on merits vide order dated 28.07.2025 in M.Cr.C.A. No. 1116/2025, therefore, this second bail application is filed on the ground that the similarly situated co-accused persons have been enlarged on regular bail in M.Cr.C. No. 5002/2005, M.Cr.C. No. 4296/2025 and other connected cases, further charge-sheet has not been filed in the present case and the investigation is still going on. He submits that the applicant is suffering from spinal disease and therefore, needs proper medical treatment. Therefore, he prays for releasing the applicant on regular bail. 4. On the other hand, learned State counsel opposes the bail application of the present applicant and submits that the FIR was registered on the basis of a letter issued by the Branch Manager of the District Cooperative Bank, Ambikapur and according to the complainant, applicant was working as Cashier and the applicant in connivance with the other co-accused persons have misappropriated some amounts in different accounts and when the same was put into light before the Chief Executive Officer, an enquiry was initiated and committee was constituted. After due enquiry, it was revealed that Rs. 26,47,82,462/- have been misappropriated by the applicant and co- accused persons and therefore, the FIR was registered. Therefore, he is not entitled for grant of bail. 3
5. I have heard learned counsel for the parties and perused the case diary. 6. From perusal of the records, it transpires that this is the second bail application of the applicant and first bail application of the applicant was rejected by this Court vide order dated 28.07.2025 in M.Cr.C.A. No. 1116/2025 on the ground that the applicant was involved in misappropriation of funds in 138 entries and the same took place between 2013-14 to 2023-24 and the total amount which was misappropriated comes to Rs. 26,47,82,462/- and further, there is no other cogent or reliable ground raised by the counsel for the applicant as also, there is no change of facts and circumstances as to the earlier bail application filed before this Court, therefore, there appears to be no new ground. 7.
Accordingly, the anticipatory bail application of the applicant – Rajendra Prasad, involved in Crime No. 39/2025, registered at Police Station – Kusmi, District – Balrampur - Ramnujganj (C.G.) for the alleged commission of offence punishable under Sections 420, 409, 467, 468, 471, 120 (B), 34 of the Indian Penal Code, 1860, stands rejected. 8.
