The Court made the following ORAL ORDER:
Heard Sri Md. Abdul Basith, learned Counsel appearing for M/s Indus Law Firm, for the Petitioner; Sri N.S.V. Ravi Teja, learned Counsel appearing on behalf of Sri Gurram Ramchandra Rao, learned Government Pleader for Education.
2. The Petitioner filed the present Contempt Case complaining violation of the direction of this Court dated 03.09.2021 in W.P.No.19033 of 2020 (Ex.P.1). Relevant portion of the direction is usefully extracted hereunder:
“In this view of the matter, this Court is of the opinion that the interest of justice would be served if the respondent No.4 is
directed to give a representation along with a copy of this affidavit stating clearly that he has no objection for keeping the petitioner at Sl.No.2 and his name is at Sl.No.3 and accordingly prepare the final seniority list for publication. Within a period of one week from the date of receipt of the said letter, the respondent No.1 is
directed to take necessary action and revise the seniority list.”
3. The Affidavit filed in support of the present Contempt Case would indicate that the Respondent No.4 in the Writ Petition has submitted the Representation. Based on the Representation submitted by the Respondent No.4, the Respondents have also prepared the Final Seniority List and published the same on 20.09.2021.
4. Learned Counsel for the Petitioner would submit that though the Final Seniority List has been published on 20.09.2021, the Respondents have failed to take any further action in this regard. Having considered the above extract passed in W.P.No.19033 of 2020, it is noticed by this Court that the Respondent No.4 has submitted the Representation. Based on the such Representation, the Official Respondents have also revised the Seniority List and published the same on 20.09.2021.
5. Having regard to these facts, this Court is of the opinion that such of those directions rendered by this Court in W.P.No.19033 of 2020 dated 03.09.2021 have all been complied with. Insofar as the grievance of the
3
Petitioner is concerned that the Official Respondents have not initiated any further action, this Court is of the view that such further action is not contemplated in the present Order (W.P.No.19033 of 2020 dated 03.09.2021) of this Court, and therefore, it cannot be held that the Respondents are in contempt of the Order of this Court.
6. In this view of the matter, the present Contempt Case is disposed of. Liberty is granted to the Petitioner to avail other remedies as available to him under law insofar as further inaction on the part of the Official Respondents is concerned.
7. With these observations and directions, this Contempt Case stands
disposed of. No order as to costs.
8. Interlocutory Applications, if any, stand closed in terms of this order.
