This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of A.B.A. No. 43 of 2025 to its original file. Learned counsel for the petitioner submits that A.B.A. No. 43 of 2025 was dismissed for non-compliance of the peremptory order of filing supplementary affidavit. It is next submitted that due to some misunderstanding of time period, the said supplementary affidavit could not be filed within the stipulated time. It is further submitted that non-compliance of the peremptory order was neither deliberate nor intentional. It is then submitted that the petitioner is ready and willing to file the supplementary affidavit. It is next submitted that the petitioner has very good grounds to agitate in the said A.B.A. No. 43 of 2025 and unless A.B.A. No. 43 of 2025 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that the A.B.A. No. 43 of 2025 be restored to its original file. Considering the facts of the case and the aforesaid submission of the learned counsel for the petitioner, A.B.A. No. 43 of 2025 is restored to its original file to the stage at which, it was before its dismissal.
