This Court, vide order dated 15.07.2024, passed in CRR No. 637 of 2013, while partly allowing the petition of the applicants, namely, Aashkaran and Rameshwar, had enhanced the fine amount of Rs. 500/- to Rs. 5000/- (each) in addition to the fine amount as already awarded by the learned trial Court and had granted one month’s time from the date of passing of the order to deposit the same. The learned Judicial Magistrate First Class, Balodabazar (C.G.) vide his request letter dated 09.01.2025 has requested that this Court had ordered the accused persons to pay enhanced fine of Rs. 5,000/-(each) to the trial Court concerned, after adjusting the amount already paid. The trial Court was subsequently directed to transmit the said enhanced fine amount to the Children Observation Home, Balodabazar. However, it has come to notice that there is no Children Observation Home in the Balodabazar district. The nearest Children Observation Home are located at Raipur and Mahasamund though, the concerned trial Court has already collected the enhanced fine amount from the accused, he has requested to provide guidance for transferring the said fine amount to the nearest Children Observation Home. 4. The request appears to be reasonable. The concerned trial Court is directed to transfer the said amount to the Government Home for Mentally Underdeveloped Children District -Raipur (C.G.), preferably within a period of two weeks from the date of receipt of a certified copy of this order. 5. Accordingly, this CRMP stands disposed off with the aforesaid direction. 6.
