Neutral Citation No. - 2025:AHC:82174-DB Court No. - 29 Case :- CIVIL MISC REVIEW APPLICATION No. - 191 of 2025 Applicant :- Surya Prakash Nigam Opposite Party :- State Of Up And 8 Others Counsel for Applicant :- Santosh Kumar Mishra,Utkarsh Kumar Mishra Counsel for Opposite Party :- C.S.C.,Shashi Prakash Rai Hon'ble Ashwani Kumar Mishra,J. Hon'ble Praveen Kumar Giri,J. Heard Sri Santosh Kumar Mishra, learned counsel for the applicant and Sri Shashi Prakash Rai, learned counsel for the respondent. This review application has been filed alongwith an application to condone the delay of 3429 days. The compassionate appointment offered to the applicant was terminated after 12 years spent in service. Learned Single Judge has dismissed the writ petition by holding that the surviving spouse of the deceased employee was already in employment. It was therefore observed that necessary ingredients to extend concession for grant of compassionate appointment did not exist in the facts of the case. This finding has been affirmed by the Division Bench in appeal. After nearly 10 years of the dismissal of special appeal and more than 25 years of the death of the employee concerned, we would not be justified in entertaining a review application on the above facts. The review application alongwith delay condonation application is dismissed. Order Date :- 17.5.2025 K.K. Maurya Digitally signed by :- KAMLESH KUMAR MAURYA High Court of Judicature at Allahabad
