Petitioner is the sole accused, he is facing trial for the offence punishable under Section 137(2), 64(2) of the BNS, 2023, Section 6 of the POCSO Act, 2012 and Section 9 of the prohibition of the Child Marriage Act. 3. Petitioner is in judicial custody from 18.09.2024. He had approached this Court in Crl.P.No.12949/2024. Since, this Court has permitted the petitioner to file a fresh petition before the Sessions Court after completion of the evidence of the victim girl and since, victim's evidence is not completed, reserving liberty to the petitioner to file a petition before the Sessions Court after the examination of the victim girl, petition is disposed of.
