Heard Mr. I.U. Chowdhury, the learned counsel appearing for the petitioners as well as Mr. K. Baishya, the learned Additional Public Prosecutor appearing for the State of Assam.
2. This is an application under Section 483 of the BNSS, 2023, whereby the petitioners, 1. Sri Harindra Chauhan, 2. Sri Manoj Chauhan & 3. Sri Chotelal Chauhan have prayed for releasing them on regular bail, after they were arrested in connection with Kheroni P.S. Case No.55/2024.
3. Mr.Baishya has submitted that in this case, police has filed the charge-sheet being Charge- Sheet No. 01/25 dated 30.01.2025. The said charge-sheet was filed before expiry of 90 days.
4. I have considered the submissions made by the learned counsels of both sides.
5. Since the charge-sheet was filed before expiry of 90 days stipulated by law, this Court is of the opinion that the petitioners do not deserve to be released on bail at this stage.
6. Therefore, all the three petitioners are adviced to approach the trial court for seeking regular bail. With the aforesaid direction, the bail application stands disposed of. JUDGE Comparing Assistant
