2. Prosecution case in brief is that the applicants and co-accused took the deceased Abhishek Lakra in Shritoli Chudha Gada Jungle and committed his murder by strangulating him with a nylon rope. It is further alleged that thereafter they cut the neck bone and separated the head from body and subsequently disposed of the dead body to conceal the crime. Based on these allegations, the present crime came to be registered.
3. Counsel for the applicants submits that the applicants have been falsely implicated on the basis of memorandum statements. It is further submits that out of 28 prosecution witnesses, 12 have already been examined. Lastly, it is submitted that the applicants are stated to be in judicial custody since 16.09.2024, the charge sheet has been filed and the trial is likely to take some time, they are ready and willing to comply with any of the conditions which may be imposed upon them and thus, it is submitted that the application be allowed and the applicants be released on bail.
4.
Learned counsel for the respondent/State opposed the bail application and submits that the nature of allegations reveal a gruesome
3 and brutal offence of murder involving beheading, which reflects the seriousness and gravity of the crime. It is submitted that the material collected during investigation including recoveries pursuant to memorandum statements, prima facie connects the applicants with the offence. It is submitted that though the charge sheet has been filed and some of the witnesses have been examined a substantial number of material witnesses are yet to be recorded and therefore he may not be released on bail.
5. Heard counsel for the parties and perused the record.
6. On due consideration of the rival submissions and the fact that from the material available in the case diary, at this stage, prima facie indicates the involvement of the applicants in the offence. Considering the seriousness of allegations, the manner of commission of crime and the gravity of the offence, I am not inclined to release the applicants on bail. Accordingly, their bail application is rejected. However, looking to the detention period of the applicants, it is expected that the trial Court shall conclude the trial expeditiously.
