--- 03 / 07.04.2025 Both these bail applications arise out of the same police station. As such, they are being disposed of by a common order. Heard the parties. 2. Petitioners have been made accused in connection with Itkhori P.S. Case No. 109 of 2024 for the offences registered under sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Additional Chief Judicial Magistrate, Chatra. 3. On 13.10.2024 at about 5.00 a.m., deceased had left his house and thereafter, he was found murdered. 4. During the course of investigation, it transpired that the deceased was having illicit relationship with the wife of the petitioner Laldhari Bhuiyan. Suspicion has been raised upon the petitioners that they might have committed the murder of the deceased. 5. Mrs. Shweta Singh, learned A.P.P has appeared in B.A. No. 1104 of 2025 and Mr. Fahad Allam, learned A.P.P has appeared in B.A. No. 1332 of 2025. has opposed the prayer for bail and after going through the case diary, submitted that there is no eyewitness to the occurrence. They have also submitted that the petitioners have confessed their guilt. They have submitted that the deceased had sustained burn injury and on the basis of their confession, hot plate and a vessel was recovered which was used in boiling water. 2. 6. Mr. A.K. Chaturvedy, learned counsel appearing on behalf of the petitioners, submitted that hot plate and vessels are common article which was found in every house. 7. Considering the nature of allegation, I am inclined to enlarge the petitioners on bail.
Accordingly, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) each, with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Chatra in connection with Itkhori P.S. Case No. 109 of 2024. (Ambuj Nath, J) Ranjeet/ Uploaded
