E= The Court made the following ORDER: T== +i +=q.:HiHED O THE HONOURABLE SRI JUSTICE K SREENIVASA REDDY CRIMINAL PETITION NO: 1072 OF 2025 ORDER: This Criml'naI Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A4, seekl'ng bail in Crime No.30/2024 of Annavaram Police Station, Alluri Sitharamaraju District. 2. A case has been registered against the petitioner and others for the offences under Sections 20(b)(ii)(C), 25 I/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act (for short llthe NDPS Act). 3. Case of the prosecution, in brief, is that on o9.08.2024, on credible information regarding illegal possession and transportation of ganja, the S.I of Police, Annavaram Police Station along with staff rushed to Lothugedda bridge, Lothugedda Panchayat and found A1, A3 to A6 while they were in possession of 3 gunny bags containing ganja weighing 102.1 kgs. The contraband along with other material was seized under the cover of mediators report and the accused were arrested on the same day i.e. on 09.8.2024. 4. Heard. Perused the record. 5. Learned Assistant Public Prosecutor submits that major part of the investigation is completed except filing of charge sheet. 3: ` I, `\>\\ I, 2 6. Wl'thout going into the merits of the case, the petitioner was arrested on 09.8.2024 and since then he I-s languishing in jail l'.e. for more than 180 days as on today. police have not completed the l'nvestigation and filed the charge sheet. As such the petitioner is entitled for default bail. 7. ln view of the aforesaid facts and circumstances of the case, this Court is inclined to grant bail to the petitioner herein, on the following conditions. (l') The petitioner/A4 herein shall be released on hl's executing a Personal bond for Rs.10,000/-(Rupees ten thousand only) with two sureties for the ll-ke sum each to the satisfaction of the learned I Additional District and Sessions Judge, Visakhapatnam; (ii) On release, the petitioner shall appear before the station House Officer concerned once in a week i.e. on every sunday between 10.00 a.m. and 05.00 p.m., till filing of charge sheet. 8.
