2 10/11/2025 The present petition has been filed on behalf of the petitioner under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 invoking the inherent jurisdiction of this Court for grant of parole as the same is being necessitated by the grave and deteriorating medical condition of the mother of the petitioner, who, as per the medical records placed on record, is presently on her death bed and whose health has precipitously declined over the past few days. The medical records Annexed as Annexure-P/3 and P/5 containing notations (illegible) and medical prescriptions, diagnostic reports and hospital records. 2. Learned Senior Counsel appearing on behalf of the petitioner submits that the instant petition is grounded upon extraordinary and compelling humanitarian considerations which necessitate the indulgence of this Court. The mother of the petitioner continues to be under intensive medical care and remains dependent of life support. The latest medical records duly annexed, unequivocally reveal that her condition is extremely critical. It is further submitted that the Apex Court upon thorough appraisal of the facts and circumstances, has non two previous occasions extended similar reliefs- firstly vide order dated 24.09.2025 in Cr.A. No. 4800 of 2024 and connected matters, by granting interim bail to the petitioner’s brother and secondly, vide order dated 7.10.2025 in Misc. Application Diary No. 55730 of 2025 in SLP (Crl.) No. 433 of 2025 by directing the release of the present petitioner on a parole for a period of four days and to report back to prison or before 12th October 2025 at 5.00 pm.
The Apex Court further granted
3 liberty to seek further interim relief in case any need arises. 3. Owing to such liberty expressly reserved by the Apex Court, the petitioner has preferred the present petition seeking grant of interim relief and while considering Cr.M.P. No. 3114 of 2025,on 13.10.2025, it was further pleased to extend the parole for seven additional days, taking sympathetic note of the deteriorating health of the petitioner's mother. 4. It is therefore submitted by the learned counsel for the petitioner that the principle underlying the grant of parole is inherently humanitarian, aimed at enabling a prisoner to attend to pressing family exigencies and uphold his filial duties in moments of grave distress. The continued critical condition of the mother of the petitioner squarely brings this case within such a narrow exceptional category warranting relief. Learned Senior counsel submits that the petitioner may be released temporarily on parole for a limited and specific duration under such stringent conditions of escort, supervision or reporting as may be deemed proper by this Court. 5. Dr. Saurabh Pande, learned counsel for the respondent does not dispute the critical medical condition of the petitioner’s mother and has not raised any objection to the grant of parole for a short and specified duration, considering the exigency pleaded. 5. Heard learned counsel for the respective parties and perused the documents placed on record as well as the orders of the Apex Court and the medical documents produced by the counsel for the petitioner. 6. 4 and taking into account the precarious health condition of the petitioner’s mother, this Court is of the considered opinion that the petitioner’s presence at her bedside is justified and warranted. As per the medical report of the petitioner’s mother (Annexure P/3 and P/5), she is currently surviving under critical medical care involving intravenous antibiotics for pneumonia, septicemic, septic shock, hyoproteinemia and kidney failure. She is reliant on multiple infusions to sustain her blood pressure and is afflicted with severe respiratory complications requiring continous mechainical ventillation with high positive end-expriaratory pressure (PEEP) and full oxygen support.
Her overalll organ function is severely compromised and the prognosis is extremely grave with minimal likelihood of recovery. 7. Accordingly, the petitioner is granted parole for a period of seven (07) days purely as an interim humanitarian measure. It is directed that the petitioner Anwar Dhebar shall be released on interim parole for a period of seven days till 5.00 pm. on 17.11.2025 subject to the condition that the respondent shall provide adequate escort at their own cost. However, it is directed that the petitioner shall report back to the prison on 17th November 2025 on or before 5.00 p.m.
8. The release shall be under adequate escort as directed. The petitioner shall report back to the Superintendent, Central Jail, Raipur immediately upon expiry of the said period.
