GP FOR HOME 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 35227/2025 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the Respondents in registering the criminal case basing on the report lodged by the Petitioner on 08.12.2025 and also the complaint of the Mandal Executive Magistrate, Addateegala dt.06.12.2025 against the miscreants, who are indulging in the acts of theft and trespass into the Eucalyptus plantation raised in the Zeroyiti land of the Petitioner of an extent of Ac.45.00 cts. in Survey Nos.60, 61, 62, 64 and 65 of 64- Kotturupadu Village, Addateegala Mandal, ASR District as illegal, arbitrary and unjust and for a consequential direction to the Respondents to provide protection to the said land and plantation of the Petitioner by registering criminal cases forthwith.…” 2. Heard Sri N.Siva Reddy, learned counsel for the petitioner and Sri P.Ajay Babu, learned Assistant Government Pleader for Home for the official respondents. 3. Learned counsel for the petitioner would submit that the respondent- police are not registering a case on the complaint made by the petitioner dated 08.12.2025. 4. Learned Assistant Government Pleader for Home, on written instructions would submit that basing on the complaint of the petitioner, the police have conducted preliminary enquiry and their enquiry reveals that the 4 subject matter is purely civil in nature. Hence, they have not registered any crime on the complaint of the petitioner. 5. Recording the same, this Writ Petition is disposed of. However, the petitioner is at liberty to work out his remedies before the appropriate forum according to law. No order as to costs.
