It is the case of the petitioner her mother by name Smt. Madhala Ananta Lakshmi, W/o.Chinna Swamy deposited amounts in three fixed
deposits with 3'“ respondent in the Writ Petition, by mentioning the of the petitioner as nominee. Later the mother name of the petitioner died

Hence, the petitioner, being iegai heir of deceased mother, requested the respondents 1 and 3 to release the on amounts under the ^ respondent in the fixed deposits, the petitioner made a representation dated 20.11.2020 to 3'^ respondent herein requesting not to change the names of depositors and nominee. Aggrieved by the action of respondents in considering her representation dated 20.11.2020, the petitioner filed the Writ Petition fixed deposits made by her mother. Alleging that 3^' Writ Petition was trying to change the nature of the No.7553 of 2022, passed in W.P.No.7553 of 2022, disposed of the said Writ Petition, with the following direction. and this Court, vide Order dated 21.04.2022
"5. Having heard the learned counsel for the petitioner and perusing the material on record and as the representation made by the petitioner has been pending since 20.11.2020, this Court deems It appropriate to dispose of the Writ Petition, with a direction to respondents, to consider the representation dated 20.11.2020, made by the petitioner and to appropriation action/pass appropriate orders, strictly in accordance with law, within a period of three (3) weeks from the date of receipt of of this order. No costs”. Complaining non-compliance of the aforesaid order, the present Contempt Case came to be filed. take a copy
3. Heard and perused the record. It is the contention of the learned counsel for the petitioner
4. inspite of the specific direction given by this Court, the respondents did not take appropriate action/pass appropriate orders by considering the representation dated 20.11.2020 made by the petitioner. In the counter affidavit filed by respondent No.3, it is stated
5. that father of the petitioner, who is the joint holder (depositor), approached the District Collector with a request to grant permission to withdraw the amounts under the aforesaid FDRs for his treatment, and pursuant to the same, the Deputy Co-operative Officer, Bhimavaram, vide
Order dated 20.10.2021, directed 3'^^ respondent to pay the amounts under the aforesaid FDRs, and on 21.04.2021, father of the petitioner daughter and another, came to the Society and withdrew the amount. It is further stated that after receipt of order in the fid along with his 2 Writ Petition, the society got issued a legal notice to the petitioner and It is further stated that in view of the intimated the above facts. aforesaid circumstances, there is no wilful disobedience to the Order Copies of the relevant papers filed along with the counter affidavit disclose that the amounts under the subject FDRs were passed by this Court. From the above, it is clear that by the date of paid on 21.10.2021 itself, passing the Order dated 21.04.2022 by this Court in the Writ Petition, there were no FDRs lying with 3'"^ respondent in the Writ Petition. 6. A perusal of the material on record further shows that the petitioner is under the apprehension that 3'“ respondent in the Writ Petition is trying to change the names of nominee relating to the fixed deposits made by mother of the petitioner. Copies of the FDRs filed along With the counter affidavit of 3^^^ respondent reveal that they are in the joint and in two FDRs names of M.Anantha Lakshmi and M.Chinna Swamy bearing Nos. 11034 and 11035, name of the petitioner is mentioned nominee and in the other FDR No. 11033, as one Kondeti Joshna Devi is mentioned as nominee. According to 3 the said FDRs can be withdrawn either together date of passing the Order dated 21.04.2022 by Petition, there were no FDRs lying with 3 this Court finds no wilful disobedience of the Order If the petitioner is aggrieved by the action of 3 rd respondent, the amounts under or survivor. As, by the this Court in the Writ rd respondent in the Writ Petition, passed by this Court. rd respondent in paying the amounts under the FDRs, she is at liberty to avail the remedies available to her as per law. 7.
