Neutral Citation No. - 2025:AHC:79169-DB Court No. - 29 Case :- SPECIAL APPEAL No. - 432 of 2025 Appellant :- Seema Varun And 9 Others Respondent :- Union Of India And 3 Others Counsel for Appellant :- Anand Prakash Yadav,Krishna Nand Yadav Counsel for Respondent :- A.S.G.I.,Siddharth Singhal Hon'ble Ashwani Kumar Mishra,J. Hon'ble Praveen Kumar Giri,J.
1. Heard learned counsel for the appellants, Sri Vivek Kumar Singh and Sri Siddharth Singhal, learned counsel for the respondents.
2. The appellants were the writ petitioners before the learned Single Judge. They assailed the direct recruitment proceedings initiated vide advertisement published by the Uttar Pradesh Subordinate Services Selection Commission on 3.8.2022. The primary ground of challenge is that the appellants were working on such posts for long and they were entitled to be regularised.
3. The writ petition has been dismissed on the ground that the appellants had also participated in the recruitment process pursuant to the advertisement issued and, therefore, mere fact that they were not selected, eventually, cannot be a ground to permit them to challenge the recruitment notification. The fact that the appellants have also participated in the recruitment process is not disputed. In such circumstances, the learned Single Judge rightly dismissed the writ petition relying upon the principles laid down by Hon'ble the Supreme Court in Pradeep Kumar Rai and others Vs. Dinesh Kumar Pandey and others, (2015) 11 SCC 493.
4. Even otherwise, we find that all the appellants were appointed after the cut of date fixed in the Regularisation Rules of 2016 and their claim for regularisation is not prima facie shown to be covered by the Regularisation Rules.
5. Viewed from both the aspects, this appeal ultimately has to fail and is, accordingly, dismissed. Order Date :- 13.5.2025/DKS Digitally signed by :- DEEPAK KUMAR SRIVASTWA High Court of Judicature at Allahabad
