Neutral Citation No. - 2025:AHC:72813 Court No. - 6 Case :- WRIT - A No. - 19722 of 2022 Petitioner :- Renu Pandey Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Kumar Ankit Srivastava Counsel for Respondent :- Arun Kumar Tripathi,Manu Singh Hon'ble Saurabh Shyam Shamshery,J.
1. Heard Sri Kumar Ankit Srivastava, learned counsel for petitioner.
2. Petitioner may have a good case being eligible for
consideration for compassionate appointment, being a married daughter or divorced daughter (divorced by an
order dated 06.12.2014), however, Court is of considered view that very purpose of compassionate appointment does not survive after 13 years since it is not disputed that mother of petitioner died in harness on 25.08.2012.
3. The impugned order has also assigned reasons that petitioner has not able to show that she was dependent on her mother after her marriage since divorce was subsequent to death of her mother and that said reason is disputed only on vague assertion.
4. The petitioner is not a bonafide litigant since in her applications dated 30.12.2015, 03.09.2021 and 30.10.2021, she has not disclosed her marital status as well as about order of divorce, therefore, no interference is warranted in impugned order.
5. Accordingly, writ petition has no force, hence, dismissed.
