The present application u/s 528 of BNSS of 2023 has been filed with a prayer to quash the order dated 17.04.2025 passed by Sessions Judge, Bhadohi at Gyanpur in Misc. Application No. 308 of 2024, whereby application under Section 5 of the Indian Limitation Act has been dismissed, which has been filed against the order dated 11.10.2023 passed by Chief Judicial Magistrate, Bhadohi at Gyanpur in Complaint Case No. 2998 of 2021, whereby the complaint has been dismissed under Section 203 of Cr.P.C.11.10.2023. After some arguments, learned counsel for the applicant does not want to press the present application. In view of above, the present application u/s 528 of BNSS of 2023 is dismissed as not pressed with liberty to file appropriate application/proceedings before the court of competent jurisdiction. Certified copies of the relevant documents be returned to learned counsel for the applicants after retaining a photocopy of the same.
