HON'BLE MR. JUSTICE R DEVDAS ORAL ORDER Learned Additional Government Advocate takes notice for all the respondents.

It is the contention of the petitioners that they have filed applications Form No.50 i.e., petitioner Nos. 1, 2, 4 and 6 have filed applications in the year 1991, Petitioner No.3 in the year 2019 and insofar as Petitioner No.5 is concerned, he has filed the application in 1998. It is contended that the applications of the petitioners have not been considered till date. In the meanwhile, the local villagers are also making a request to form a layout under the ‘Ashraya Scheme’ and forms sites and distribute the same to siteless persons. However, the petitioners contends that the lands for which claim has been made by

HC-KAR NC: 2025:KHC:37787 WP No. 25471 of 2025 the petitioners by filing Form No.50 should not be considered for the purpose of ‘Ashraya Scheme’.
3. Having regard to the contentions raised in the writ petition and submission of the learned Counsel for the petitioners, this Court is of the considered opinion that respondent No.4-Tahsildar was duty bound to place the applications filed by the petitioners before ‘Committee for Regularization of Unauthorized Occupation’ and the Committee was also duty bound to consider the application and pass necessary orders.
4. Consequently, the writ petition stands disposed of with a specific direction to respondent No.4-Tahsildar, Kanakapura Taluk, to verify from the records as to whether such applications were filed by the respective petitioners in 1991, 1998 and 2019 are pending
consideration. If it is found that such applications were indeed filed by the petitioner and the application is yet to be considered, respondent No.4-Tahsildar is directed to

HC-KAR NC: 2025:KHC:37787 WP No. 25471 of 2025 place before Committee, the application along with his recommendation within a period of four weeks from the date of receipt of a copy of this order. Thereafter, Committee shall consider the applications and pass necessary orders in accordance with law as expeditiously as possible and at any rate within a period of two months thereafter. Ordered accordingly. Learned Additional Government Advocate is permitted to file memo of appearance within a period of four weeks from today.
