Neutral Citation No. - 2025:AHC:69590 Court No. - 10 Case :- WRIT - C No. - 14552 of 2024 Petitioner :- Nishant Rastogi And 2 Others Respondent :- State Of Up And 3 Others Counsel for Petitioner :- Narendra Mohan Counsel for Respondent :- C.S.C. Hon'ble Piyush Agrawal,J. Heard Sri Narendra Mohan, learned counsel for the petitioners and Sri Shashi Kant Mishra, learned standing counsel for the respondents. By means of the present writ petition the petitioners have challenged the orders dated 12.12.2019 passed by the Additional District Magistrate, Farrukhabad as well as 15.3.2024 passed in Appeal No. 00102 of 2020 under section 56(a) of Indian Stamp Act, 1899. The sole ground as taken in the writ petition was argued by the learned counsel for the petitioners that the spot inspection was made in violation of Rule 7(3) (c) of the U.P. Stamp (valuation of Property), Rules, 1997. Under the said Rules, once one of the purchasers was present at the time of spot inspection there was no violation of the Rules. Pursuant to the earlier order of this Court learned standing counsel has placed the original records. The Court has perused the original records. From a perusal of the original records it transpires that one of the purchasers was present at the time of spot inspection, which has not been disputed by the learned counsel for the petitioners. In view of the above, no cause of action survives to interfere with the impugned orders. The writ petition is dismissed.
