1. The present writ petition has been filed for the following reliefs:-
“for grant of an appropriate writ in the nature of Certiorari or an order or direction for quashing the order dated 29.09.2023 (Annexure-5) passed by the respondent No.3 in Misc. Appeal No.01 of 2023-24 whereby the order dated 19.09.2022 passed by the respondent No.4 in Misc. Appeal No.01 of 2019-2020 has been set aside and for any other appropriate writ or order or direction as this Court may deem fit and proper.”
2. The description of the land is as follows:-
“Mouza – Jagarnathdih, Thana No.329, Khata Nos.01, 20, 68 and 78, Plot Nos.199, 228, 229 & 230, measuring Rakba 1 acre and 89 ଵ ଶ decimals.”
3. It has been submitted that there is mutation dispute between the parties. The original order passed by the Circle Officer is in favour of

respondent no.6. Thereafter, appeal has been preferred by the petitioner and the appellate order is in favour of the petitioner and against the said order revision has been filed by the respondent no.6 before the Additional Collector who is not the Competent Authority under the Jharkhand Tenants’ Holdings (Maintenance of Records) Act, 1973.
4. The Deputy Commissioner, Giridih has taken suo moto cognizance as a Revisional Authority and has been set aside the order of the Additional Collector whose order was void ab initio as being without jurisdiction.
5. In view of the above factual matrix and considering the mandate of the Jharkhand Tenants’ Holdings (Maintenance of Records) Act, 1973, the
order dated 29.09.2023 (Annexure-5) passed by the Additional Collector, Giridih in Misc. Appeal No.01 of 2023-2024 is hereby quashed and set aside. Accordingly, the present writ petition is hereby allowed and disposed of reserving liberty with the party to file revision before the Deputy Commissioner who is a competent and authorised officer.
6. With aforesaid liberty, the present writ petition is hereby disposed of.
7. Pending I.A., if any, also stands disposed of.
