Short prayer made by the petitioner in the present petition, which is a institution imparting courses, inter alia, for Bachelor in Physical Education, is that vide order dated 15.05.2015 (Annexure P-3) permission was granted for conducting the said course for the Academic Session 2015-2016 with intake capacity of 50 students for one basic unit of 35 students, subject to fulfillment of certain conditions. 2. Learned counsel for the petitioner by referring to the National Council for Teacher Education (Recognition Norms and Procedure) Regulations, 2014 appended as Annexure P-6 submits that under Appendix 7, Clause 3 the intake capacity for the said course is prescribed at a minimum block of 100 students with two sections of 50 each. Learned counsel for the petitioner submits that while issuing the recognition order the Northern Regional Committee has passed the order in ignorance of the provisions contained in Clause 3 of Appendix 7 and, therefore, the petitioner-institute has made a representation dated 11.11.2023 (Annexure P-4) to the Chairperson of the Appeal Committee of NCTE, New Delhi, which is still pending. 4 Learned counsel for the petitioner further submits that the petitioner shall be satisfied if directions for disposal of the said representation are issued. 5. Accordingly, without entering into merits of the matter, present writ petition is disposed of with the directions to the respondent-NCTE to decide the representation dated 27.07.2024 preferred by the petitioner and if the same has not been received by the Appellate Committee of NCTE, the petitioner shall file a fresh representation alongwith copy of this order. Upon receipt of copy of this order, the Appellate Committee of NCTE shall decide the appeal within a period of 60 days by passing a speaking order.
