1. Heard the learned counsel for the parties.
2. This anticipatory bail application under Section 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 has been preferred by the petitioner apprehending his arrest for offences registered under Sections 47 (a) & 55 of the Excise Act, in connection with Complaint (Excise) Case No. 2356 of 2024, pending in the Court of learned Judicial Magistrate – Ist Class, Hazaribagh.
3. The allegation against the petitioner is that in a go-down petitioner illegally kept Indian made foreign liquor, quantity of which was 5,623.9 liters. It is alleged that this petitioner and others are engaged in hoarding and sales of foreign liquor without any valid documents / license.
4. During course of the argument, it has been brought to the notice of this Court that there are six other criminal cases pending against this petitioner which are of similar nature, which clearly suggests that the petitioner is a habitual offender. Thus, this is not a fit case to grant anticipatory bail and I am not inclined to grant Anticipatory Bail to the petitioner.
5. Accordingly, this Anticipatory Bail Application is dismissed.
