ORDER: This writ petition is filed under Article 226 of the Constitution of the India seeking the following reliefs:-
“to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction on the part of the respondent No.3 in considering petitioner representation dated 06.11.2024 through which petitioner has requested not to mutate the land in an extent of Ac. 1.28 Cents out of Ac.2.82 cents in Sy.No.486/4A1 of Chavvaripalli Village fields, Simhadripuram Mandal, YSR Kadapa District in favor of the respondent No. 4 since the same stands in the name of mother who was expired on 14.06.2024 basing on unregistered MOU, dated 19.01.2024 without issuing of any notice to petitioner as Illegal, arbitrary, abdication of statutory duty caste on him, apart from being fundamental rights guaranteed to petitioner under Articles 14, 19 and 21 of the Constitution of India and consequently direct the respondent No.3 not to mutate the land in an extent of Ac.1.28 Cents out of Ac.2.82 cents in Sy.No.486/4A1 of Chavvaripalli Village fields, Simhadripuram Mandal, YSR Kadapa District and pass such other order. ”
2. Heard the
learned counsel for the petitioner and the learned Government Pleader for the respondents.

Learned counsel for the petitioner submits that the petitioner and the 4 respondent herein jointly succeeded the subject land admeasuring to an extent of Ac. 1.28 cents out of Ac.2.82 cents in Sy.No.486/4A1, Chavvaripalli Village Fields, Simhadripuram Mandal, YSR Kadapa District from their ancestors. Since then, they have been in possession and enjoyment of the subject property. While being so, the 4"^ respondent who is none other than the
brother of the petitioner and joint holder of the subject property is trying to mutate his name against the subject property in collusion with the official respondent Nos.2 and 3 herein. The petitioner also submitted a representation dated 06.11.2024 to the 3^" respondent requesting not to mutate the subject land in favour of the 4 respondent herein without following due process of law. 4. On the other hand, learned Government Pleader furnished written instructions issued by the 3'^^ respondent dated 21.04.2025, wherein it is stated as follows;
“In this connection I submit that in the above said representation dated 06.11.2024 submitted by the petitioner, he represented that in the survey No.486/4A1 extent of Ac.2.82 cents of Chavvaripalli Village Fields, but the said survey number is existing in Paidipalem Village Fields not in Chavvaripalle Village Fields. As the representation given by the petitioner said survey number was in the name of his mother. But she
14.06.2024. Out of the above land an extent of an died on Ac.1.54 cents has been acquired by his brother Palleti Venu Gopal Reddy remaining Ac.1.28 cents has been given to his mother for her livelihood but at present his brother Palleti Venu Gopal Reddy is forcing the Revenue Authorities to mutate the said Ac. 1.28 cents in his name. The petitioner has requested not to mutate the land in revenue records without his permission. Further, I submit that Sri Palleti Madhusudhan Reddy, brother of Sri Palleti Venu Gopal Reddy has submitted a representation to this office in which he represented that
there is dispute between himself and \fenugopal Reddy '^c. 1.28 cents Simhadripuram Mandat the mutation. Hence possible to perform Venugopat Reddy. ’’
5. Having regard to the counsel for the petitioner and submitted by the learned Government this Court deems it directing the 3^^^ mutation either by the petitioner follow due Andhra Pradesh Rights and Rules made thereunder. 6. With the above direction, the Writ Petition i no order as to costs.
