ORAL ORDER
Petitioners are seeking to quash the FIR in Cr.No.289/2025 registered at Mahadevapura Police Station, Bengaluru City, for the offence punishable under Section 305 of BNS, 2023.
2. Respondent No.2/defacto complainant has reported to the police that some unknown persons have committed theft of gold jewelleries and cash from his house. List of stolen articles were furnished in the complaint.

3. In the course of investigation, petitioners were arrested and articles mentioned in the complaint were recovered.
4. A joint affidavit of the petitioners and respondent No.2 has been filed along with the application seeking to compound the offence and to quash the proceedings.
5. It is stated that the petitioners and respondent No.2 are close relatives and at the intervention of the elders, well wishers and the family members of both side, the matter has been settled amicably.
6. Respondent No.2/defacto complainant and the petitioners are present before the Court. Respondent No.2 submitted that the matter has been settled and the articles which were seized in this case have been released in his favour. He submitted that in view of the settlement, he does not intend to pursue the matter any further and he has no objection to quash the proceedings.

7. From the facts and circumstances of the case, it is seen that the matter is purely private in nature wherein the parties, stated to be close relatives, have settled the dispute among themselves. Since respondent No.2 is not willing to proceed with the matter, continuation of proceedings initiated against the petitioners will not serve any purpose. Hence, this Court is of the considered view that the proceedings pending against the petitioners can be closed. Hence, the following:
ORDER
i. I.A.No.1/2025 is allowed. Consequently, the petition is allowed.
ii. The entire proceedings arising out of Cr.No.289/2025 of Mahadevapura Police Station, Bengaluru City, pending before the XXIX Additional Chief Judicial Magistate, Bengaluru, is quashed.

iii. The articles released in favour of respondent No.2 by virtue of the order passed by the learned Magistrate is made absolute.
