K KRISHNA BUSHAN CHOWDARY(CENTRAL GOVERNMENT COUNSEL) The Court made the following: 3 THE HONOURABLE SRI JUSTICE MAHESWARA RAO KUNCHEAM WRIT PETITION NO: 44282 of 2017 Order: This Instant Writ Petition is filed by the petitioner under Article 226 of the Constitution of India seeking the following prayer; “….to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus declaring impugned action of the respondents in not awarding 10 marks towards service weightage to the petitioner, as per the Notification No. 01/CGM(HR)/2010, dt. 05.01.2011 and supplementary Notification No. 01/CGM(HR)2011, dated 17.10.2011, in spite of petitioner submitting gate passes, EPF records in proof of his service from 01.11.2003 to 31.01.2005 as illegal, arbitrary and violative of Article 14 and 16 of Constitution of India, consequently, direct the respondents to conduct verification of the service of the petitioners with reference to gate passes and EPF Records and award total 10 marks towards the service weightage for further consideration of the petitioner to the post of Junior Attendant in the interest of justice.” 2. On 24.12.2025, this court passed the following order: “No representation for the petitioner. It is submitted by Sri Krishna Bhushan Chowdary, learned Standing Counsel for APGENCO, that consequent to the notification dated 17.10.2011, all the posts in the respondents‟ Corporation have been filled. 4 He submits that the petitioner was unable to substantiate his assertion that he worked in the respondents Corporation from 01.11.2003 to 31.01.2005. So as to give one more opportunity to the petitioner, post next week under the caption „for dismissal‟. Registry is directed to print the name of Sri Krishna Bhushan Chowdary, learned Standing Counsel for APGENCO, in the Cause list.” 3. Even today also, when the matter is taken up for hearing, there is no representation on behalf of the petitioner, though the case is listed under the caption ‘for dismissal’. 4. In the above circumstances, the Writ Petition is dismissed for non-prosecution. There shall be no order as to costs.
