The present application is being filed for grant of leave to file appeal against the order of acquittal passed by the learned 14th Joint Civil Judge Senior Division and Additional Chief Judicial Magistrate, Nagpur in Summary Criminal Case No.5717/2022, wherein, the respondent herein is acquitted for the offence punishable under Section 138 of the Negotiable Instruments Act, 1881. 3. Today, the learned counsel for he appellant/applicant submits that the parties have arrived at settlement and therefore, they do not want to prosecute the present matter further. To that extent, he has placed pursis dated 23.09.2025 which is marked as ‘X’ for identification. 4. Considering the above facts and circumstances, learned counsel for appellant/applicant seeks permission to withdraw the present application 2 29 appa 1228.24 5. Leave granted. 6.
