GP FOR REVENUE (AP) 2 HBKM,J W.P.No.3899 of 2020 The Court made the following Order:- Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the 4th respondent in issuing the proceedings in R.Dis.No.648/2019 dated 17.01.2020 and consequently direct the respondents not to dispossess the petitioner from the land and follow the due process law. 3. On the other hand, the learned Assistant Government Pleader relying upon the written instructions of the 4th respondent dated 23.09.2025 submits that the land in Sy.No.787-1 in an extent of Ac.0.70 cents and Sy.No.787-3 in an extent of Ac.0.26 cents of Bukkarsayasamudram Village have been acquired for the welfare scheme of housing to distribute the house sites to the house less poor BPL families. The land compensation amount was also paid for an amount of Rs.7,68,000/- and it was credited to the present petitioner’s Bank Account No.32209056030 of State Bank of India, Bukkarayasamudra Branch. The then Tahsildar, Bukkarayasamudra Mandal resumed the subject land to the Government in Sy.No.787-1 to an extent of Ac.0.70 cents, Sy.No.787-3 to an extent of Ac.0.26 cents and Sy.No.788 to an extent of Ac.0.75 cents of Bukkarayasamudra Village under Section 4(1) of the Act 9 of 1977 as he violated the conditions of D-Form patta and also contravened the provisions contemplated under Section 3 (1) & (2) of the Act 9 of 1977. 3 HBKM,J W.P.No.3899 of 2020 4. In reply, the learned counsel for the petitioner submits that the above said compensation is paid only to the part of land in an extent of Ac.0.26 cents only out of Ac.1.71 cents. For the balance acquisition, no compensation is paid so far. 5. In view of the above said facts and circumstances, if the petitioner is aggrieved by the proceedings of the 4th respondent dated 17.01.2020, it is always open for him to prefer an appeal against the said order of the 4th respondent before the 3rd respondent, by following the due procedure, if so advised. 6. Accordingly, this Writ Petition is disposed of. Interim order if any deemed to have been vacated. There shall be no order as to costs. The written instructions of the 4th respondent dated 23.09.2025 shall be made as part of the Court record.
