JUSTICE S.G.PANDIT) The petitioner is before this Court under Article 226 of the Constitution of India, assailing the order dated 28.05.2025 in Application No.150/2025 passed by the Karnataka State Administrative Tribunal, at Bengaluru (for short “Tribunal”), whereby the Tribunal quashed the order of penalty of withholding one increment for a period of 6 months, without cumulative effect and remanded the matter for further enquiry. - 3 - HC-KAR NC: 2025:KHC:32671-DB WP No. 20550 of 2025 2. Heard learned counsel Sri.Ranganatha S Jois for petitioner through video conference and learned AGA Sri.V.Shivareddy, for respondents. 3. After arguing the matter for some time, Sri.Ranganatha Jois files a memo dated 21.08.2025 reads as follows: “The petitioner in the above petition had challenged the punishment order dated 20.12.2024 imposing on him the punishment of 20.12.2024 (Annexure-A8) in the original Application before the Hon’ble KSAT, Bengaluru Bench, Bengaluru. The punishment period is over on 20.06.2025, the Hon’ble KSAT though allowed the application has remanded the matter to enquiry which causes further hardship to the petitioner. The said order of the Tribunal is challenged in the above writ petition. Now the petitioner intends and seeks the permission of this Hon’ble Court to withdraw the original application in A.No.150/2025 itself - 4 - HC-KAR NC: 2025:KHC:32671-DB WP No. 20550 of 2025 so that the petitioner service benefits are not affected. Hence, the petitioner seeks the kind leave of this Hon’ble Court to withdraw the Original Application in A.No.150/2025 before the Hon’ble KSAT, Bengaluru and the same may be permitted in the interest of justice and equity.” 4. Learned counsel Sri.Ranganatha Jois would submit that the penalty imposed under order dated 20.12.2024 is implemented and the penalty period has come to an end. In that view of the matter, learned counsel would submit that the petitioner seeks permission to withdraw the Application No.150/2025 filed before the Tribunal itself. 5. As the petitioner withdraws the challenge to the order of penalty dated 20.12.2024 by withdrawing the Application No.150/2025, we permit the petitioner to withdraw the application filed before the Tribunal. - 5 - HC-KAR NC: 2025:KHC:32671-DB WP No. 20550 of 2025 6. Application No.150/2025 filed before the Karnataka State Administrative Tribunal at Bangalore is permitted to be withdrawn and the same is dismissed as withdrawn. 7.
