Heard the learned counsel for the petitioner, the learned Assistant Government Pleader for Municipal Administration and Urban Development, the learned Government Pleader for the Finance & Planning and the learned Standing Counsel. 2. Learned counsel for the petitioner submits that the petitioner was entrusted various works and while entering into agreements deposited the Further Security Deposit (FSD), Earnest Money Deposit (EMD) as required under the terms of contract. The petitioner has executed works as entrusted by the respondents and also submitted the final bills. The defect liability period is also over as the works were completed way back in the year 2015-2016. Learned counsel appearing for the petitioner further submits that once work is completed there is no in justification withholding the FSD and EMD amounts. 3. Learned standing counsel for the 6th respondent submits that certain amounts were deferred by the Municipality, however, in so far as completion of work and recording of the progress of work in the M-Books is not disputed. 4. On these considerations, this Court is inclined to dispose the writ petition directing the respondent No.6 to verify and release Further Security Deposit (FSD), Earnest Money Deposit (EMD) deposited by the petitioner towards various works to the petitioner as expeditiously as possible preferably within a period of six weeks from the date of receipt of a copy of this order. 5. Accordingly, the Writ Petition is disposed off. No costs.
