CIVIL JUDGE AND J.M.F.C., ANEKAL.

ORAL ORDER Heard the learned counsel for petitioners, learned High Court Government Pleader for the State and perused the material on record.
2. FIR in Crime No.231/2025 of Bannerghatta Police Station is registered against two named and other accused for the offence punishable under Section 118(1), 352, 351(2), 351(3), 3(5) of BNS, 2023.

3. In the complaint lodged by one Ravi Kumar, he has alleged that on 08.08.2025 at about 8.10 p.m., when he was near one Anshika Bar and Restaurant, Jangalpalya Gate, Jigani, Anekal Taluk, accused Nos.1 and 2 along with others came and abused him and assaulted on his head with beer bottles and while trying to avoid the said assault, he sustained injuries to his right hand. Thereafter, the said accused went away threatening him with dire consequences etc.
4. In the remand application, 8 accused are named. Petitioners are shown as accused Nos.2, 4 and 5 in the remand application.
5. The learned High Court Government Pleader contended that, the further statement of the complainant has been recorded and there is a prima facie case against the petitioners. He contended that, petitioner No.1 is involved in other criminal cases.

6. Petitioners are not named in the FIR. In the remand application they are shown as accused Nos.2, 4 and 5 respectively. The Specific allegations are against one Harish and Rakesh whose names are found in FIR. In the remand application they are shown as accused Nos.1 and 3 respectively. Omnibus allegations are made that other accused have also assaulted the complainant. Petitioners are already arrested and interrogated. As per wound certificate, victim has sustained simple injuries.
7. In the above
facts and circumstances, petitioners can be admitted to bail by imposing conditions. Accordingly, the following:
ORDER i. Petition is allowed. ii. Petitioners/accused Nos.2, 4 and 5 in Crime No.231/2025 of Bannerghatta Police Station, Bengaluru

District shall be enlarged on bail, subject to following conditions:
1. They shall execute a personal bond in a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for the likesum to the satisfaction of the jurisdictional Court.
2. They shall furnish proof of their residential address and shall inform the Court, if there is change in the address.
3. They shall not directly or indirectly tamper with the prosecution witnesses.
4. They shall not commit any offence.
5. They shall appear before the trial Court on every date of hearing without fail.
Violation of any of the above conditions shall result in cancellation of bail.
