THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 13619 of 2021
ORDER:
1. This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for:
“…to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents particularly 2nd respondent in interfering with the construction activity of the petitioner on her site of 2 cents of land in Sy.No.163/5 of Porumammilla village and Mandal, YSR Kadapa District at the instance of the 3rd respondent without any authority, without any valid reason or ground and without registering any case against the petitioner though civil suits are pending as illegal, unjust, arbitrary, highhanded, malafide and against statutory provisions and consequently direct the respondents particularly 2nd respondent not to interfere with the construction activity of the petitioner on her site of 2 cents of land in Sy.No.163/5 of Porumammilla village and Mandal, YSR Kadapa District at the instance of 3rd respondent...”
2. Heard Sri L.J.Veera Reddy, learned counsel for the petitioner and Sri V.Farook, learned Assistant Government Pleader for Home for respondents.

Learned counsel for petitioner would submit that petitioner as well as 3rd respondent have filed two separate suits, which are pending before competent civil court. Learned counsel would further submit that while the petitioner has been proceeding with the construction activity, 2nd respondent
has obstructing his construction activity and interfering in the civil dispute at the instance of the 3rd respondent. Learned counsel would further submit that there is interim direction to the police not to interfere in a civil dispute between the parties. Let the petition may be disposed of making that order absolute.
4. Learned Assistant Government Pleader for Home for respondents would submit that since the civil suits are pending between the parties, police are not interfering in the civil dispute and no crime has been registered against the petitioner.
5. Recording the same, the writ petition is disposed of. However, police are directed not to interfere in the civil dispute, except under due process of law.
As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
