COMMON ORDER: These two Criminal Revision Cases are heard and disposed of by way of this common order as the Petitioner/Accused and Complainant/Respondent No.2 in both these cases are one and the same. 2. The Criminal Revision cases were filed under Sections 438 and 442 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) challenging the order dated 21.07.2025 passed in Crl.M.P.Nos.99 & 100 of 2025 in Crl.A.Nos.118 & 119 of 2025. 3. This Court on 22.09.2025 passed order, while staying the operation of impugned order, directing the Petitioner to deposit 10% of the cheque amount within a period of two weeks. Learned Counsel for the Petitioner submits that
3 Petitioner has already deposited 20% of the cheque amount on 20.09.2025 i.e., two days prior to passing of above order. 4. In view of the deposit of 20% of the cheque amount already by the Petitioner before the learned Trial Court, the order directing the Petitioner to deposit 10% of the cheque amount before the learned Trial Court can not be given any kind of effect.
The order dated 22.09.2025 with respect to directing the Petitioner to deposit 10% of the cheque amount is required to be recalled and the amount of 20% of the cheque amount deposited by the Petitioner before the learned Trial Court need not be disturbed. 5. The Criminal Revision Case was filed challenging the order dated 21.07.2025 in directing the Petitioner to deposit 20% of the cheque amount before the learned Trial Court. Since the Petitioner, as on the date of passing the interim order by this Court i.e., on 22.09.2025, has already deposited 20% of the cheque amount, nothing remains in this revision case for further adjudication. 6. Therefore, the Criminal Revision Cases are disposed of at the stage of notice itself. The learned Trial Court is at liberty to proceed in accordance with law on any application filed by the Repsondent No.2/Complainant seeking for withdrawals of 20% of the cheque amount. 7. Accordingly, the Criminal Revision Cases are disposed of. No order as to costs. As a sequel, interlocutory applications, if any pending, shall stand closed. 4 _________________________ Dr. Y.
