Mr. Pranav Saxena, learned counsel for the applicant. 2. Mr. Siddharth Bisht, learned A.G.A. and Mr. Chitrarth Kandpal, learned Brief Holder for the State. 3. Applicant Rakshpal Singh, S/o Inder Singh is praying for regular bail in relation to FIR dated 17.02.2025, registered as FIR/Case Crime No. 0071 of 2025 at P.S. Kashipur District Udham Singh Nagar wherein the present applicant has been implicated along with one Iccha @ Dolly for the offences punishable under Sections 64(1), 123 of BNS 2023. 4. Learned counsel for the applicant submits that applicant is innocent and has been falsely implicated. He further submits that in fact the applicant and the victim are in love and victim was major at the time of alleged incident which is also evident from the statement of the victim recorded under Section 164 Cr.P.C. 5. Counter affidavit has been filed in the Court and Mr. Siddharth Bisth, learned A.G.A. submits that victim in her statement admits this fact that she went with the applicant in his bike. He has not disputed this fact that the victim is major and furthermore even as per the statement of the victim both of them known to each other since last six months. Apart from this he submits that charge sheet has already been filed therefore there is no need of custodial interrogation of the present applicant and applicant has no previous criminal history. 6. Having heard learned counsel for the parties and further taking into consideration that charge sheet has 2025:UHC:4373 already been filed and there is no need of custodial interrogation of the applicant, this Court is of the view that the applicant deserves for bail. 7. Accordingly, without expressing any opinion on the merits of the case, the bail application is allowed. 8. Let the applicant Rakshpal Singh be released on bail on his executing a personal bond and furnishing two reliable sureties of the like amount to the satisfaction of the court concerned.
