Neutral Citation No. - 2025:AHC:77497 Court No. - 5 Case :- WRIT - A No. - 6530 of 2025 Petitioner :- Babita Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Anand Kumar Pandey Counsel for Respondent :- C.S.C.,Kirtika Singh Hon'ble Ajay Bhanot,J. The petitioner claims that family pension of her deceased father to which she is entitled has not been disbursed to her. She has made a representation in this regard but to no avail. The only prayer made by Shri Anand Kumar Pandey, learned counsel for the petitioner is that representation of the petitioner regarding disbursal of family pension may be decided within a stipulated period of time. Ms. Kritika Singh, learned counsel for the respondent nos. 5 and 6 submits that the matter requires determination of facts by the competent authority in light of applicable provisions of law in the first instance. However, she fairly contends that service benefits/claim is liable to be decided by the competent authority in a reasonable time frame. In wake of the aforesaid submissions and without going into the merits of the case, the respondent no. 5 is directed to decide the representation of the petitioner for disbursal of family pension after verifying her credentials and noticing all other legal heirs of the deceased employee as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally disposed of. Order Date :- 13.5.2025 Dhananjai Digitally signed by :- DHANANJAI High Court of Judicature at Allahabad
