12.12.2025 CRL.M.A. 37180/2025 (for modification of order dated 07.11.2025)
1. This application seeks modification of paragraph 10 of the order dated 7th November, 2025 in BAIL APPLN. 4079/2025, specifically praying for reduction of the surety requirement from two sureties of INR 25,000/- each to one surety of INR 10,000/-.
2. Counsel for the Applicant argues that although regular bail was granted, the Applicant remains in custody as he is unable to furnish the sureties earlier required. He has been in judicial custody for over 2 years and 9 months, has no family or social support in Delhi, and despite genuine efforts, has been unable to arrange the sureties. His continued detention is thus not on account of any judicial finding on the merits, but solely because of the onerous surety condition, which has made the grant of bail ineffective. 3. Having considered the submissions and perused the application, and noting that the State does not dispute the factual position regarding the Applicant’s inability to furnish sureties, this Court is satisfied that a case for modification of the surety condition is made out.
4. Accordingly, paragraph 10 of the order dated 7th November, 2025 stand modified as under:
“10. The Applicant is, therefore, directed to be released on bail on furnishing a personal bond for a sum of ₹10,000/- with one surety of the like amount, subject to the satisfaction of the Trial Court/Duty MM, on the following conditions: a. The Applicant shall cooperate in any further investigation as and when directed by the concerned IO; b. The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case or tamper with the evidence of the case, in any manner whatsoever; c. The Applicant shall, under no circumstance, leave the country without the permission of the Trial Court; d. The Applicant shall appear before the Trial Court as and when
directed; e. The Applicant shall provide the address where he would be residing after his release and shall not change the address without informing the concerned IO/ SHO; f. The Applicant shall, upon his release, give his mobile number to the concerned IO/SHO and shall keep his mobile phone switched on at all times. g. The Applicant shall report to the concerned PS on first Friday, every three months;”
5. The application is disposed of. The pending application is also
disposed of.
