(ORAL) CRM No. 35169 of 2025 This is an application under Section 528 of BNSS for addition of offence under Section 80 of BNS in the head note and prayer clause of the petition. Learned counsel for the applicant-petitioner submits that vide order dated 14.5.2025, the petitioner was granted the concession of interim bail by this Court. Subsequently, vide order dated 15.7.2025, the said order was made absolute by this Court. It is the submission of the learned counsel for the applicant-petitioner that during investigation, the offence under Section 80 of BNS, 2023 was added in the present FIR vide G.D. No. 37 dated 3.6.2025. It is submitted that initially the present FIR was registered under Section 108 of BNS, 2023, therefore, the applicant-petitioner was not aware about the addition of Section 80 of BNS, and the said fact could not be brought to the notice of this Court at the time of the final adjudication of the bail matter. Therefore, it is prayed that the present application be allowed and the offence under Section 80 of BNS, 2023 be ordered to be added in the head note, prayer clause of the main petition as well as in the order dated Gurpreet Singh 2025.09.17 09:24 I attest to the accuracy and integrity of this document Chandigarh CRM No. 35169 of 2025 IN/AND -2- CRM-M No. 26048 of 2025 15.7.2025 passed by this Court. However, now when the factum of not having made the correct submissions at the time of adjudication is brought to the notice of this Court, it is deemed appropriate, under such circumstances, that the present application be dismissed. Accordingly, the present application is dismissed. The order dated 15.07.2025 is recalled. On the oral request of the learned counsel for the petitioner, the main case is taken up on board for hearing. CRM-M-26048-2025 1. Learned counsel for the petitioner seeks leave to withdraw the instant petition with liberty to file a fresh one with better particulars. 2. Leave granted. 3.
